Tasks
-Help prepare for and attend mediation and arbitration. -Assist in all aspects of private and public construction law including prevailing wage mandates, union issues, competitive bidding requirements, delay claims, warranty issues, subcontractor claims, liens, stop notices, and bond claims, among others. -Conduct contract trainings for McCarthy team members. -Proactively engage other stakeholders and subject matter experts as appropriate to address anticipated legal issues. -Manage subcontractor defaults; work with project teams to ensure that McCarthy’s interests are properly protected by subcontractors’ bonding companies; and manage litigation arising out of any contractual breach by subcontractors and/or their sureties. -Provide timely, accurate analysis of project owner agreements, prepare written memoranda and executive summaries, and lead contract review meetings. -Articulate risks and opportunities in clear and understandable terms to help project teams understand contracts and/or claims and make timely and informed decisions. -Draft memoranda, correspondence, and reports summarizing legal research and offer opinions regarding liability, risk transfer, and exposure. -Participate in relevant peer groups to drive consistency and adaptation of best practices. -Coordinate with the Risk Management department relating to builder’s risk, general liability, professional liability and other insurance issues; work with project teams relating to coverage for construction defect, builder’s risk, auto, worker’s compensation, and property damage claims. -Review and respond to subcontractor and supplier requests to modify McCarthy’s agreements. -Identify and communicate legal risks and opportunities while demonstrating a deep understanding of construction contracting matters, industry trends, and business needs. -Provide legal guidance relating to communications with various national, state, and local regulatory agencies; assist in responding to investigations by applicable regulatory agencies; manage outside counsel during administrative hearing processes. -Manage outside counsel and assist with document requests, discovery responses, and review of draft pleadings. -Develop new agreements as needed and, in collaboration with peers, update McCarthy’s library of templates in response to changes in legislation and industry trends. -Recommend contract modifications and negotiation strategy in collaboration with McCarthy’s Operations partners.

What You Bring
-Juris Doctorate from an ABA accredited law school and licensed in at least one U.S. state. -Meticulous attention to detail and quality of work product. -Minimum of 5 years’ experience as an attorney. -Excellent verbal and written communication skills. -Ability to work independently and determine creative solutions. -Proven ability to handle multiple projects, prioritize, and meet deadlines. -Ability to communicate complex legal concepts to McCarthy team members in a straightforward manner. -Strong interpersonal skills and ability to work with a wide variety of people. -Experience working with construction agreements and familiarity with construction law.
