Director, Commercial

Description

The Commercial Director oversees commercial strategy on projects, working closely with senior operations to develop and implement a commercial management system that drives performance and mitigates risk. This role provides sound commercial and contractual advice during bid and execution phases and manages the commercial interface and relationship with the client.

• Develop and administer processes for change request documentation, challenge, and defense throughout project execution.
• Implement claim management procedures to resolve unforeseen issues, including third‑party claims and defense of incoming claims.
• Ensure timely delivery of all contractually required notices to the client per project agreement terms.
• Administer project contracts (agreements, subcontracts, consultancy, purchase) with sound administrative practices from inception to completion.
• Lead drafting, review, and negotiation of various contracts (services, master agreements, commissioning, engineering, settlements, NDAs, construction, procurement) to optimize financial, legal, risk, and reputational outcomes.
• Oversee procurement scheduling, competitive tendering, bid evaluation, and recommendation of suppliers for materials, goods, services, and equipment.
• Provide regular commercial reporting and analytics to internal executives, JV Executive Committee, and Project Managers.
• Coordinate with insurance advisors to develop appropriate project insurance programs and coverage.
• Engage legal advisors as needed to obtain counsel on contractual matters.
• Create and monitor a risk management and mitigation plan, analyzing risks during bid and execution phases.
• Manage commercial close‑out activities, including defect liability period and operations & maintenance transition.
• Lead and align a team of commercial direct reports, holding individuals accountable for results and ensuring effective, results‑focused commercial activities.

Requirements

• Minimum 15 years of commercial management experience on major EPC infrastructure projects (>$500 M) from bid to close‑out, including joint‑venture environments.
• Degree in Law, Engineering, Quantity Surveying or equivalent.
• Proven expertise with standard and bespoke construction contracts, change management, claims identification, quantification, and evaluation.
• Strong understanding of construction methodology, large‑scale project cash flow, and contract law in the project jurisdiction.
• Hands‑on experience with tendering, contract administration, cost control, procurement, earned‑value management, and Primavera P6 scheduling.
• Demonstrated success in claims management, dispute resolution, and risk identification/mitigation.
• Ability to liaise effectively with clients, subcontractors, and consultants; knowledge of insurance program requirements.
• Familiarity with integrated ERP systems.
